on a subject, the historical precedent will apply, and unless that has been
changed without my knowledge,
it follows that in Nova Roma the charge of the games falls to the Aediles
since that is the old
Roman way. Since this is the case, it becomes the assignment of the Aediles
to gain sponsors for the games. Now unless the government is the sponsor,
the Aedile whose turn it is sponsors the games or finds a sponsor.
Traditionally in Nova Roma the Curule Aediles are the sponsors, which puts
the Curule Aediles in charge of the games.
Now since the race is part of the game, you become the overseer of the races.

Now that we have established legitimacy, again I ask, what does these ad hoc
appointments have to do with a magistracy that requires an oath? The answer?
None.

In a race which is part of a ludi, the Curule Aedile may indeed have the
authority to say what goes where. Other races? Good question. And just
'cause he has authority there, doesn't mean he can't delegate that
authority, but in fact precedent would make it that he can.

Now, regarding the oath for appointed positions. Having read a few of
the edicts in question, it seems to me that the appointing magistrates
have requested of their scribas to pledge their intention to fullfill
their duties in the same way elected magistrates are, by law, required
to do so.

Is it wrong of these magistrates to request this same display of
commitment by their "future employees"? Maybe, it might be a bit much to
expect the same degree of commitment from appointed officials as from
elected magistrates. But these citizens have been able to decline their
appointments by not taking the oath, yet none have chosen to do this.

However, these citizens, these appointed officials, willingly take an
oath to show the same commitment as elected magistrates. Through this,
they show how dedicated they are to both our republic, Nova Roma
herself, and to fulfilling duties which others might neglect without a
guilty conscience.

Should we condemn them for this dedication, and condemn the magistrates
asking them to display it, or should we commend them for it? Are they
lessening their dignitas, or are they investing it where it may grow
from their work for the republic? Think about it.

Games could be put on by any citizen who cared to pay for them
Senator, as I'm sure you know. The Aedilean responsibility lies in
the maintenance of good order and public morality at the games.
The fact that the Aediles often paid for the games out of their
own funds is beside the point.

Perhaps you missed my earlier post in which I agreed with you
that the domini factionis ought not to be swearing the magisterial
oath. However, my Curule Aedilean colleague Caeso Fabius
Quintilianus has a different opinion on the matter. He and I are
discussing the issue in private, and if he should have anything
further to say on the matter, I'm sure it will be forthcoming.

Whatever CFQ's ultimate decision on the matter, in a very few days
my colleague elect Franciscus Apulus Caesar and I will be deciding
which of the existing Aedilean edicta to continue, and if we wish to
let any portions of said edicta lapse with the changing of the year.

A quick definition is all magistrates elected by the people or
appointed by the Senate. The quickest way to find them is to go the
magistrates' page linked off the main Nova Roma page. There you will
find censors, consuls, praetors, Tribunes of the Plebs, Aediles,
quaestors, Curator Differum, Curator Araneum, rogators, interpreters.
All these should take the oath. On the provincial level the governors
and legates should take the oath as well.

If a magistrate feels some need for his assistants (accensi, scribes,
etc) to take an oath he is free I suppose to make one up for them,
but it shouldn't be the magistrate's oath. The purpose of the
magistrate's oath is primarily to protect the Religio Romana as the
state religion of Nova Roma and protect the Constitution; it helps
prevent magistrates from subverting them. It is a specific sacred
obligation placed on the oath taker on top of the obligations given
the magistrate by the People or the Senate. Apparitores are easy to
get out of office, they are personal assistants that serve at the
whim of their magistrate--who can release them at any time. A
magistracy is a more serious position that cannot be released at
whim.

This is not a reason, it is a non sequitur. Scribae are apparitores,
not magistrates. No one, I would argue, can compel a scribe or an
accensus or the Domini Factionum to take a magistrate's oath since
they are not magistrates. The Constitution, Section IV.9.
states: "the apparitores shall not be considered magistrates."

Cassia Iunia de Iusiurando. For the definition of apparitores, look
to the Constitution and the Lex Vedia Apparitoria. You may dismiss
those who disagree with you by saying they are merely "entitled to
their opinion," but I would please ask you to remember the same can
be said to you, especially when you are not careful about defending
your opinion, as on this occasion.

pretty well and its application and required use I believe to be
fairly straightforward.

First of all I want to tell You that I have no problems with

I have understood that this is your "baby" and I admit that oaths are
not one of my areas of expertise. As You may remember there was a
debate about the oaths some time ago and we found out that there were
different approaches towards oaths according to which cultural
background each person had. I admit that I am one of those who have
no close relation to oaths. Still, in my own way, I take them very
seriously, and this is the reason that I ask my scribae to swear the
oath.

During the early years of Nova Roma, I used to identify myself as Marcus
Audens. I assumed that such a signature was sufficient since I believe
I am the only Audens in NR to date.

For that "breach", I was very severely criticized, and my intelligence
called into question by one of the Senior Magitrates some time ago, for
not abbreviating my full name properly, even though I preferred the
above abbreviation. I would suppose from that exercise, one could draw
the conclusion that everyone has one or two small "sticking points" in
thier dealings with others, some important and some not so important.

However, the criticism hs actually been beneficial in that I have for so
long now stated my full name on the Main List and in those messages
where I felt a full name was necessary, that I no longer notice the
extra effort required. On those lists where I am assured of the
friendship of those to whom I am addressing, I use the name "Audens"
alone.

I find that such a solution seems to work well, and I have not recieved
any recent chastisement regarding my preference for how I name myself.
I certainly understand and agree that with the increasing number of NR
Citizens that using one's full name on the Main List is probably a very
good idea. I also have some problems in determing just who it is that
is posting, and in that case I have liitle choice except to ignore that
message and move on.

Thank you for your kind words. I was trying to make my point politely
and firmly, yet sometimes that comes across as rude. I am glad it did
not. Thank you for reading it in the manner it was intended. This
medium makes misunderstanding possible.

I am sure there will be many times we will agree as well as disagree,
but be sure that what I say will be constructive and not obstructive.
Whether we agree and disagree on a particular issue, in the end we
are working for the same goal--Nova Roma.

Well, sure, isn't that the point? :-) We don't have legions to lead
or actual cities to administrate so we fight over nits and picks.
It's the like the saying about academia, the fights are so bitter
because the stakes are so small. Or put another way, we take
ourselves too seriously because we know no one else will! ;-)
("you're a senator in what?? Yeah, whatever.")

Discussions in Nova Roma quite regularly degenerate into acrimonious
scuffles, and people leave in a huff. Experience has shown that if
possible it is better to be overly cautious and polite in discussions
than otherwise.
