Senatus consultum ultimum on Nova Roman lists/groups

SENATUS CONSULTUM ULTIMUM ON NOVA ROMAN LISTS/GROUPS

I. This Senatus consultum ultimum is issued by the Senate under the authority granted to it under section V.E of the Constitution of Nova Roma.

II. All previous classifications of which mailing lists are considered to be:

A. Official lists/fora, including religious lists B. Public fora C. Officially sponsored fora D. Senate sponsored lists

are overridden.

III. Henceforth only the following classifications of mailing lists/groups, not including social media groups, operating as a lawful part of Nova Roma shall prevail:

A. Officially sponsored lists (public fora) as per section II.B.4 of the Nova Roman Constitution, open to all citizens with full posting rights. Moderation policies shall apply to such lists.

B. Official magistrates lists concerned with the administration of the constitutionally or Senate designated business of that office by the incumbent(s), open only to magistrate(s) holding that office, lawfully appointed staff of magistrates (cohors), citizens directly involved in a participatory manner in the proceedings the magistrate(s) is responsible for, and senators. The aforementioned persons shall have full posting rights. Other citizens not directly involved may be added or removed from such a list at the discretion of the magistrate(s) in whose business such other citizens express an interest. Such other citizens may only view the content of the list but shall not have posting rights on such a list. Moderation policies shall apply.

C.Official magistrates lists concerned with the confidential/private administration of the constitutionally or Senate designated business of that office by the incumbent(s) and cohors business, open only to magistrate(s) holding that office, lawfully appointed staff of magistrates (cohors) and senators. Senators who are not also designated magistrates or members of the magistrate(s) cohors for a list may only view the content of the list but shall not have posting rights on such a list. Moderation policies shall apply to such lists.

D.Official Religio Romana lists concerned with the administration of the constitutionally designated business of the Collegium Pontificum and Collegium Augurum, open only to the designated religious officials for such lists, senators and other authorized persons designated in the senatorial legal authority creating them. Senators and other authorized persons who are not also designated religious officials for a list may view the content of the list but shall not have automatic posting rights on such a list. Such posting rights, or lack thereof, must be specified in the legal authority creating the list. Moderation policies shall apply to such lists.

E. Official Urbs (central government) lists, open only to the magistrates and/or officials designated by the Senate as being responsible for their administration, lawfully appointed staff of magistrates (cohors), citizens designated under the relevant senatorial legal authority creating them and senators. The aforementioned persons may, or may not, have full posting rights as determined under the relevant senatorial legal authority. Moderation policies shall apply to such lists.

F. Senate list, as specified in the SENATUS CONSULTUM DE RATIONE SENATUS MMDCCLXV, open only to senators, those extant grandfathered non-voting members of the Senate list as per the Lex Popillia senatoria as amended by the Senatus consultum ultimum on the Lex Popillia senatoria, and any other magistrate that may be invited to the Senate list under the terms of the SENATUS CONSULTUM DE RATIONE SENATUS MMDCCLXV. Moderation policies shall apply to this list as per the SENATUS CONSULTUM DE RATIONE SENATUS MMDCCLXV.

G. Senate standing committee lists, open only to those senators who are the designated members of a committee. Moderation policies may apply to such lists.

H. Other senate official lists open only to those persons specified by the senate under the relevant senatorial legal authority creating them. Moderation policies may apply to such lists.

I. Official senate endorsed and approved corporation (universitas) lists, open only to the members of that corporation as specified in its foundation authority creating it and senators. Senators who are not also designated members of the corporation may only view the content of the list but shall not have posting rights on such a list. Moderation policies may apply to such lists.

J. Consortium (societas) lists, open only to the members of that consortium. Moderation policies may apply to such lists.

K. Official senate endorsed and approved collegium lists (excepting the Collegium pontificum and Collegium augurum dealt with above), whether state or private, open only to the members of that collegium as specified in its foundation authority creating it and senators. Senators who are not also designated members of the collegium may only view the content of the list but shall not have posting rights on such a list. Moderation policies may apply to such lists.

L. Official senate endorsed sodalitas lists (henceforth after enactment of this Senatus consultum ultimum only religious cults specifically authorized by the Collegium pontificum, and subsequently endorsed by the Senate, shall form a sodalitas), open only to the members of that sodalitas as specified in its foundation authority creating it and senators. Senators who are not also designated members of the sodalitas may only view the content of the list but shall not have posting rights on such a list. Moderation policies may apply to such lists.

M. Official senate endorsed Gens lists, open only to the members of the specific gens subject of the list. Moderation policies may apply to such lists.

N. Official gens endorsed Familia lists, open only to members of the specific familia subject of the list. Moderation policies may apply to such lists.

O. Official senate endorsed provincial local community lists, only open to the members of the specific community structure (whether that structure is a vicus, castrum, opidum, municipum, colonia or provincia) and senators. The aforementioned persons shall have full posting rights. Moderation policies shall apply to such lists.

P. Former official lists now retired and defunct and not being listed as members of III.A to III.O, and which are retained for senatorial archive purposes, where access to such is available depending on ownership. The list herein is not comprehensive, and other defunct lists maybe located and added to the Register of Lists subsequently.

IV. The owners of the lists classified as being:

A. Lists as described at III.A, III.B, III.C, III.E, III.F, III.G, III.H, and III.O shall be the members of the Senate Information Technology Task Force (ITTF). No other person(s) shall be an owner of these lists.

B. Lists classified as being lists as described at III.D and III. L shall the the Pontifex maximus and any other person(s) appointed to such a role by the Pontifex maximus. No other person(s) shall be an owner of these lists.

C. Lists classified as being lists as described at III.I, and III.K shall be the persons appointed to such a role under the relevant senatorial legal authority creating them. No other person(s) shall be an owner of these lists.

D. Lists classified as being lists as described at III.M shall be the persons approved by the senate as paterfamilias or materfamilias of the specific gens subject of each list, and any other person subsequently appointed by the gens paterfamilias or materfamilias. The senate shall be informed of who these additional appointed owners are. No other person shall be an owner of these lists.

E. Lists classified as being lists as described at III.N shall be the persons approved by the paterfamilias or materfamilias of their specific gens as being the paterfamilias or materfamilias of the specific family subject of each list, and any other person subsequently appointed by the familia paterfamilias or materfamilias. The senate shall be informed of who these additional appointed owners are. No other person shall be an owner of these lists.

F. Lists classified as being lists as described at III.J shall be the person(s) creating the consortium and any other person(s) he/she may designate.

G.Lists classified as being lists as described at III.P shall be the persons as designated by the relevant senatorial legal authority retiring them.

V. Sections V.a to V.e of the Lex Cornelia poenalis are overridden, but section V.f is preserved. Upon enactment of this Senatus consultum ultimum the Code of Conduct in the Lex Cornelia poenalis shall apply to all lists at III.A to III.P above.

VI.

A. Unless authorized otherwise by the relevant senatorial legal authority creating/retiring the list concerned, the members of all lists at III.A to III.P must only be Nova Roman citizens, who shall only be subscribed and retained on such lists using only the email address registered in their online account accessed through the URL http://www.novaroma.org/civitas/myaccount.

B. No other email account(s) other than the listed email account at that URL for each citizen shall be subscribed to any list at III.A to III.P. A citizen may not use multiple email accounts to subscribe to a list. A citizen shall not provide another citizen, or non-citizen, with his/her Nova Roman citizen account details and/or email account details, including passwords, for the purpose of access to the citizen account and/or lists at III.A to III.P, whether to view the content of such lists and/or post on such lists, or misrepresent himself/herself as another person, whether such a person he/she is misrepresenting as is an authorized user of such a list or not.

C. Any person who commits an act contrary to section V.A or V.B above shall be deemed to have committed a violation of any relevant section of the Code of Conduct that pertains to the commission and/or nature of such an act.

D. The only language that must be used on all lists is English, as per the Lex Cornelia de linguis publicis. Exceptions to this are:

a. Any collegium where the senatorial legal authority establishing it specifically establishes another language as the primary language for use on that collegium's list. In such cases English will be the secondary language. b. Any province/local community where the primary national language is not English. The primary language will be the language spoken by the majority of the local community. In such cases English will be the secondary language. c. The grandfathered Sodalitas Latinitatis, until such time as it is abolished and replaced by an appropriate collegium. d. Where a post is made on any list herein, or subsequently added to the Registry of Lists, in Latin, an accurate translation of the full Latin content of that post must be provided in English and contained within the same post as the Latin, appended after it.

E. An owner(s) or moderator(s) of any list classified as III.A to III.O is required to identify and report to the Senate any actions/posts on his/her list that contravene the Code of Conduct of the Lex Cornelia poenalis, or, the various Senatus consultum ultimum or Senatus consultum on Competing Organizations and/or conflicts of interest. Such reports should be directed by email to the Princeps senatus.

F. Any failure or refusal by a member of the Senate, or a magistrate, to discharge a duty required under this Senatus consultum ultimum shall constitute CONTEMPT OF THE SENATE for the purposes of the SENATUS CONSULTUM DE RATIONE SENATUS MMDCCLXV.

G.

a. No Nova Roman magistrate, or official whether appointed or elected, shall create a list, whether public or private, for the conduct of the business of his/her office or responsibilities. All cohors business shall be conducted on the III.C classified lists for that magistrate/official. b. All Nova Roman business must be conducted on the lists provided to magistrates and officials herein, or as may be provided subsequently by the approved processes herein. c. No business conducted on such unauthorized lists shall be considered legal business, and all actions that flow from such illegal decisions are themselves illegal. d. The creation and/or use of such an unauthorized list shall be for the purposes of section II.B.4 of the Nova Roman Constitution deemed to represent and imminent and clear danger to the Republic and as such subject to the penalty prescribed in the Lex Cornelia poenalis for section VI.b.iii concerning damage to corporate assets.

H.

i. Any subsequent addition of new lists must follow the classification and methodology herein. ii. List owners of lists classified as III.I, III.J, III.K, III.L, III.M and III.N shall every census year confirm on the Register of Lists that their list is still active. If they fail to do so their list may be subject to removal from the register. iii. The ITTF will administer the Register of Lists and registration process and will design the methodology of registration and re-registration.

I. Where a list has no moderator appointed or the moderator(s) is unresponsive the owner(s) shall subsitute for the moderator in the full performance of the role, including the application of list moderation policy.

J. The lawful membership of a list shall be the combination of the owner(s), moderator(s) and authorized person(s) subscribed to the list.

K.

a. All lists herein and any that are subsequently created according to the process and methodology herein are subject to the internal laws of Nova Roma and to oversight by the Senate of Nova Roma.

b. The ultimate ownership of all lists herein, and any future lists as are added to the Register of Lists through the approved process herein, resides in the Senate of Nova Roma. The ITTF may create such lists as it considers necessary for the furtherance of the Functions and Missions of Nova Roma.

c. List owners hold the lists in trust for the Senate through the exercise of Yahoo. ownership rights.

d. All lists herein, and as are subsequently added through the approved process herein, are considered as the property of Nova Roma.

e. The general purpose of all lists is the furtherance of the functions (http://www.novaroma.org/nr/Functions_(Nova_Roma) ) and missions http://www.novaroma.org/nr/Missions_(Nova_Roma) of Nova Roma.

f. The specific purpose(s) of any list must support the functions and missions of Nova Roma and assist in the good and effective governance of Nova Roma.

g. No transfer of ownership is permitted unless approved by the ITTF. The ITTF may in an emergency receive ownership of any list that it is not already a designated owner of and hold that list in trust until such time as an appropriate owner(s) can be determined, or the list closed and removed from the Register of Lists. Any unauthorized transfer of ownership shall if so executed be considered theft and/or damage of/to a corporate asset under the Code of Conduct of the Lex Cornelia poenalis.

h. No change in the authorized purpose of any list is permitted and shall if so executed be considered damage to a corporate asset under the Code of Conduct of the Lex Cornelia poenalis.

i. No change in allegiance from that owed to Nova Roma to another organization/group is permitted and shall if so executed be considered to be theft of a corporate asset under the Code of Conduct of the Lex Cornelia poenalis.

j. Any Nova Roman citizen who creates an unauthorized list by means other than that authorized herein and represents such a list as an official list of Nova Roma shall be deemed to have committed a violation of section VI.b.vii of the Code of Conduct of the Lex Cornelia poenalis - "The surrender or sabotage of the corporate status of Nova Roma Inc. by any method that is illegal and/or unconstitutional" and shall be liable to the penalty therein.

k. In cases of disputes between the list owner(s) the ITTF shall adjudicate the matter and be the determining authority on the matter, or if the owners are the ITTF then the Senate shall adjudicate. In cases of dispute between the list owner(s) and the list moderator(s) then the list owners shall be the be the determining authority on the matter, subject to the oversight of the ITTF that can has the final and ultimate authority in such cases.

l. Cross posting (the act of "cc"'on a post/email to two or more lists, or the copying of the content of one post from one list to another post on another list) between lists is forbidden, except in respect of the Senate list where permitted under the SENATUS CONSULTUM DE RATIONE SENATUS MMDCCLXV, or items posted to the Praeconium list which may lawfully be cross-posted to the Rostra. Posting of the results of the Senate in Formal Session shall be to the Rostra (by the Tribune(s)) and Praeconium only. References in any legal authority to the posting of senate debates during Formal Session, as opposed to results of the Senate in Formal Session, to posting on the Forum list or Main List, or any similar phrase or implied direction, shall henceforth be interpreted as posting to the Rostra only. The members of the ITTF may as they deem necessary and suitable cross-post from the Amphitheatrum, the Circensis, the Theatrum, the Wiki and the Praeconium to any of the initial stage ius Latii lists, or to the Collis Aventinus, for the purposes of enhancing the knowledge base of the ius Latii and exposing them to Nova Roman events. The prohibition on cross-posting includes posting to external (i.e non-Nova Roman) organizations, person(s) who are not Nova Roman citizens (including direct posting to persons who are members of the ius Latii) by persons other than the members of the ITTF. No content from any Nova Roman list herein, or subsequently added to the registry of Lists, shall be posted to a Facebook account that is open to non-citizens, or includes non-citizens, unless such a posting has been authorized by the ITTF. Also excluded from this prohibition on cross posting are those posts that are authorized by any other valid and subsisting Senatus consultum ultimum.

m. Any citizen, ius Latii or other list member subscribed to a list that disregards the prohibition above on cross-posting shall be subject to either moderation of posting rights, suspension from the lists concerned (or any or all lists he/she is subscribed to), or in cases where the conduct of the person responsible is deemed by the ITTF to represent and imminent and clear danger to the Republic as per section II.B.4 of the Nova Roman Constitution then that person, if a citizen, shall be subject to the penalty prescribed in the Lex Cornelia poenalis for section VI.b.iii concerning damage to corporate assets. If in such cases of a clear and imminent danger that person is not a citizen then they shall be forthwith expelled from the list(s) indicated by the ITTF by the owner(s) of the list(s). Any owner of a list that refuses to expel such a non-citizen upon direction of the ITTF is themselves deemed to have committed a violation of the Code of Conduct of the Lex Cornelia poenalis, namely damage of/to a corporate asset under the Code of Conduct of the Lex Cornelia poenalis and shall be subject to the appropriate penalty prescribed. Other Code of Conduct violations may be occasioned by the behavior of the person cross-posting and/or any owner(s) that refuse to take action against that person(s).

n. On lists where senators have a right to be subscribed by virtue of their senatorial appointment, they are not obligated to join such a list, but they may join and leave and re-join as they wish, as many times as they wish. As senators they are required to have the ability to exercise oversight if they deem it necessary to do so. List owners/moderators shall not penalize senators for re-subscribing/leaving as they wish, even if the exercise of this right results in multiple subscriptions and leaving the list concerned. They are to be afforded prompt rights of access to such lists and not impeded in the exercise of their senatorial duty of oversight.

L. Only lists herein, or any that are subsequently created according to the process and methodology herein, are permitted to use the Nova Roman trademarked device (http://www.novaroma.org/nr/Trademark).

M. The moderation policies of all lists herein any that are subsequently created according to the process and methodology herein are deemed to include the Yahoo Terms of Service (https://policies.yahoo.com/us/en/yahoo/terms/utos/index.htm). Owners and moderators of all lists herein, and any that are subsequently created according to the process and methodology herein, are required to ensure that all of their list members comply with those Terms of Service.

VII. The following lists are the initial members of the respective classifications at III.A to III.P above as indicated, and the persons shown as indicated for each are responsible for their primary administration as moderators. Any list included in this list, with the exception of III.P classified lists, are considered active Nova Roman lists. Any list not appearing in this initial group below will have to comply with the registration process above in order to be considered an active Nova Roman list.

A. III.A classified lists:

i. Forum (https://groups.yahoo.com/neo/groups/NR-Forum/info) - moderators shall only be the praefectus urbi and any senators he/she wishes to appoint as moderators. Moderation policy shall be determined by the ITTF.
ii. Rostra (https://groups.yahoo.com/neo/groups/NR-Rostra/info) - moderators shall only be the praefectus urbi and any senators he/she wishes to appoint as moderators. Moderation policy shall be determined by the ITTF.

B. III.B classified lists: Basilica (https://groups.yahoo.com/neo/groups/NR-Basilica/info) - for consuls, censors, praetors, aediles and the praefectus urbi, all of whom shall be moderators. No cohors members of any of those magistrates, or any other person(s), shall be moderators, although they may be subscribed to the list to assist their magistrate/official. Moderation policy shall be determined by the ITTF.

C. III.C classified lists:

Moderation policies for each of the above III.C lists shall be as determined by the magistrate or official who the list serves, or in cases of a joint list by all the magistrates for that list acting in a collegiate manner. In cases where a joint set of magistrates is unable to reach a consensus on a moderation policy shall be determined by the ITTF. The cohors members of a magistrate/official can be subscribed to their respective magistrate's/official's list.

D. III.D classified lists:

i. Suburana (https://groups.yahoo.com/neo/groups/NR-Suburana/info) - moderators shall be the aedile plebis not recording the largest amount of votes (junior) or in cases of a tied vote the aedile plebis with the shortest citizenship of the two, and some or all of his/her lawfully appointed cohors staff. All members of this list shall have full posting rights. Moderation policy shall be determined by the aedile plebis assigned to the list. The only citizens that shall be subscribed to the list are those citizens in the Capite censi, Class V (5th Class) and senators.

ii. Esquilina (https://groups.yahoo.com/neo/groups/NR-Esquilina/info) - moderators shall be the aedile plebis recording the largest amount of votes (senior) or in cases of a tied vote the aedile plebis with the longest citizenship of the two, and some or all of his/her lawfully appointed cohors staff. All members of this list shall have full posting rights. Moderation policy shall be determined by the aedile plebis assigned to the list. The only citizens that shall be subscribed to the list are those citizens in Class IV (4th Class), Class III (3rd Class) and senators.

iii. Collina (https://groups.yahoo.com/neo/groups/NR-Collina/info) - moderators shall be the aedile curule not recording the largest amount of votes (junior) or in cases of a tied vote the aedile curule with the shortest citizenship of the two, and some or all of his/her lawfully appointed cohors staff. All members of this list shall have full posting rights. Moderation policy shall be determined by the aedile curule assigned to the list. The only citizens that shall be subscribed to the list are those citizens in Class II (2nd Class) and senators.

iv. Palatina (https://groups.yahoo.com/neo/groups/NR-Palatina/info) - moderators shall be the aedile curule recording the largest amount of votes (senior) or in cases of a tied vote the aedile curule with the longest citizenship of the two, or in cases of a tied vote the aedile curule with the longest citizenship of the two, and some or all of his/her lawfully appointed cohors staff. All members of this list shall have full posting rights. Moderation policy shall be determined by the aedile curule assigned to the list. The only citizens that shall be subscribed to the list are those citizens in Class I (1st Class) and senators.

v. Collis Aventinus (https://groups.yahoo.com/neo/groups/NR-IL-CollisAventinus/info) - moderator shall be the praetor urbanus as the praetor recording the largest amount of votes (senior praetor) or in cases of a tied vote the praetor with the longest citizenship of the two. Other moderators shall only be senators designated and appointed by the senate. No cohors staff or other persons shall be appointed as moderators. Moderation policy shall be determined by ITTF. Membership of this list shall be restricted to those persons authorized under the SENATUS CONSULTUM ULTIMUM ON THE CITIZENSHIP PROCESS, THE IUS LATII AND ASSOCIATED MATTERS, and any other senatorial legal authority relating to the administration of this list.

vi. Campus Martius (https://groups.yahoo.com/neo/groups/NR-CampusMartius/info) - moderator shall be the censor who is not the most recently elected/appointed censor, with the incumbent changing yearly on January 1st, and some or all of his/her lawfully appointed cohors staff. Other authorized persons shall be peregrini (non-citizen, non-ius Latii), and senators and those citizens that apply to the Senate through the ITTF for permission to be subscribed, and who are approved for such purpose. In determining whether a citizen should be subscribed to this list consideration must be given to whether he/she can be considered to be a good ambassador for Nova Roma, its functions and missions, and for the Senate. Moderation policy shall be determined by the ITTF.

vii. Trans Tiberim (https://groups.yahoo.com/neo/groups/NR-TransTiberim/info) - moderator shall be the praetor peregrinus as the praetor not recording the largest amount of votes (junior praetor) or in cases of a tied vote the praetor with the shortest citizenship of the two, and some or all of his/her lawfully appointed cohors staff. Other authorized persons shall be peregrini (non-citizen, non-ius Latii), senators and those citizens that apply to the ITTF to be subscribed. Successful applicants will be those who are considered to be good ambassadors for Nova Roma, its functions and missions, and for the Senate for the purposes of interacting with potential future citizens. The ITTF will review existing list membership at the time of enactment of this Senatus consultum ultimum to ensure that the citizens currently subscribed can be so described as good ambassadors. Moderation policy shall be determined by the ITTF.

The tribunes shall not determine moderation policy, but shall enforce the existing policy set by the consuls, or in their absence the praetors.
d. Comitia plebis tributa (https://groups.yahoo.com/neo/groups/NR-ComitiaPlebisTributa/info) - moderators shall be the tribunes and some or all of their lawfully appointed cohors staff, and is open to all citizens but only plebeian citizens shall have full posting rights. Non-plebeian citizens can view the list messages but cannot post. Moderation policy shall apply and shall be determined by the tribunes.

Posting rights on these lists, must be disabled when a comitia is not lawfully in session, called to order by its appropriate magistrate for the purpose of conducting its constitutionally appointed functions. Posting rights during a lawful session will be restored for citizens subscribed to it. Owners and moderators of these lists are also forbidden from posting to such a list during any period when a comitia is not lawfully in session. These comitia lists are not for out-of session discussions, or posting of any sort. Posts that announce the imminent commencement of a lawful session will be permitted to be posted on such a list about to commence session, but such information must only be posted on the list within 48 hours of the commencement of the lawful session. Moderators that abuse this function will have their posting rights limited or suspended, or in extreme circumstances their right to moderate the comitia list concerned removed by the ITTF, notwithstanding any right to be a moderator on such a list assigned herein. Any failure by a member of the ITTF to abide by this prohibition shall be dealt with directly by the Senate.

VIII. Upon enactment of this Senatus consultum ultimum:

A. The only lawful method of subsequently superseding, amending or repealing this Senatus consultum ultimum must be by way of a Senatus consultum ultimum, that must achieve an extraordinary majority before it can be enacted. Any other method or attempt shall be illegal and forbidden. The Princeps senatus may at his/her discretion replace the requirement above for an extraordinary majority with a requirement for a special majority, or a simple majority.

B. No other Senatus consultum ultimum shall be enacted where the proposed content of which conflicts, negates, overrides, limits or otherwise affects in a negative manner the contents and/or purposes of all or any part of this Senatus consultum ultimum, whether directly or indirectly other than by the method at specified at section VIII.A of this Senatus consultum ultimum.

IX. This Senatus consultum ultimum shall terminate on the 31st December 2022, unless it shall be terminated earlier under the process described at section VIII.A of this Senatus consultum ultimum.
