OATH OF OFFICE
+
Preface
Context
+
As is the case with most organizations, Nova Roma asks its citizens to respect a social contract. This contract consists of abiding by the constitution of Nova Roma, respecting the Religio Romana, and venerating the Roman values. Those who serve as Magistrates within Nova Roma take on additional duties however, and their combined work keeps the organization operational and in good stead. Due to the greater weight of responsibility they take on, those who enter into positions of Magistracy are asked to take an oath of office upon assuming the respective office.

As every human organization, Nova Roma waits that her/his members respect Its basic common contract. This contract is about respecting the Constitution, the higher law in Nova Roma, the Religio romana and the Roman values.

Among Nova Roma members and citizens, the magistrates have more duties, for they are in charge of the working of the organization, the State of Nova Roma. As such, they are thus asked to take an "oath of office".

Investiture Ceremony
Applicable texts
+
Here follows the ceremony of investiture. You will see that you can simplify this ritual
+
greatly if you want to avoid too much ceremony, and the ceremony also respects your
+
personal religious views (you can do a Roman religious, a Christian or an irreligious version
+
of it, whichever you prefer). You have to send the oath of office to TheForumRomanum@groups.io once the ritual of investiture is completed.

Two texts adopted in Comiata centuriata, or, rather, one law amended by a second one two years later, rules this field:
+
The ceremony of the investiture is below, if you cannot do parts of it, you can skip those
+
parts, or figure out some kind of substitution ideas.

*Lex Iunia de iusiurando - 19 Oct 2752
+
First Step
modified by:
+
* Lex Cassia Iunia de iusiurando - 04 Dec 2754.
+

In fact, lex Cassia just repaired a major formal omission: lex Iunia had just issued the raw oath formula, with no further explanation.
+
You should don your simple white toga and your tunica of your status (for
+
example equestrian if you are one, or senatorial if are, or by taking this office, are becoming
+
one). Women can don a white toga or a white palla if they prefer, or if there is no white, any
+
color will do which you consider your best clothes. If you don't have Roman clothes, simply
+
close up nicely as worthy of the occasion.

+
Second Step
Contents of the applicable law
+
While wearing your toga offer a sacrifice of wine or incense or a libum of bread, fruit, or milk and make a prayer in which you ask the Roman gods to acknowledge your entrance to the position to which you are about to enter, asking their support to ensuring you bring glory and happiness to Nova Roma and the Nova Roman people. If you adhere to the Cultus Deorum ensure that Jupiter Optimus Maximus is invoked and, if you do not cultivate the Roman gods, simply make a prayer to your god of choice instead.

1st rule
+
To make an offering there are two ways to undertake it: If you do not have a proper altar you can light a candle, place the candle within a bowl, and pour the liquid from your libation into the bowl in such a way that you ensure it does not extinguish the candle. The amount of liquid you offer doesn’t need to be excessive, with one or two tablespoons being more than sufficient. If the offering is bread, fruit, or incense you can hold it in the fire for a few seconds and then simply place it into the bowl. After the ritual is complete you may dispose of the contents of the bowl by returning it to nature, pouring or placing the contents somewhere along the lines of a under a bush or by the roots of a tree. If something prevents you from being able to dispose of the offering in nature you may dispose of it in the garbage, though this manner is not ideal.

"(..) An Oath of Office [is created] for any citizen assuming any magistracy of Nova Roma, whether elected or appointed." Lex Cassia Iunia de iusiurando - 2nd §.
+
If you are addressing the Christian God a sacrifice is not necessary, but the lighting of a candle will serve as a sufficient substitute for the process. If you do it in this way, though, you should ask a cultor (ideally a priest of Nova Roma) to give an offering to mark your entrance to office in your stead.

Any citizen
+
Third Step
The Oath of office just concerns the citizens, who are the ones who can assume a magistracy. Even if this rule seems obvious, lex Cassia wisely reminds it.
+
If you are a curule magistrate you should change from your plain white toga to a purple-bordered toga (the toga praetexta). After completing this next step, all citizens taking an oath should touch a symbol of Nova Roma (i.e. a Nova Roma banner, printed logo, or drawing of the emblem of Nova Roma).
The socii cannot thus assume a magistracy.
+

A magistracy
+
Fourth Step
This requirement of an oath does not concern the offices which are not a magistracy.
+
While vested in toga praetexta and holding the symbols of your office (if you have
+
any), read aloud in Latin and/or in your NATIVE TONGUE the version the Oath of Office.
+
The symbol of consulship, praetorship and curule aedileship can be the toga praetexta,
+
sella curulis, an eagle, a scepter; for the consulship and praetorship only the fasces or a
+
sword.

Are thus excluded:
+
Fifth Step
- the civil public offices which are not called "magistracies", as the positions not mentioned as such in the Constitution, especially for these ones are offices assigned, to help them, to magistrates. Are in this group the assistants (accensi, viatores, scribes), but also all the provincial officers who sit under the responsibility of the governor;
+
- the religious officers;
+
- the members of assemblies, i.e. members of comitia or senators, but also members of provincial and local assemblies.
+

Any magistracy
+
After completing your oath, you will need to proclaim aloud that you have ascended to your new position in Latin. Using the proper Latin title for your given position, declare:

Lex Iunia modified does not distinguish between the magistracies: every magistrate, especially recognized as such by the Constitution of Nova Roma, must take the oath.
+
"[Latin Position Name] factus sum!" (I have been made a [Your New Position]).

Are thus concerned, not only the central magistrates, but the provincial and/or local ones.
+
Once you have done this you are ready to assume your new position!

+
Sixth Step
Elected as appointed magistrates
+
Make a post on Nova Roma's Main List (The Forum Romanum) stating your name and confirming that you have performed the ritual of investiture and offered sacrifice.

The election is not the medium which create the obligation of the oath, but the type of office (magistracy) assumed. Appointed magistrates must take the oath, as provincial governors, but also as interreges and dictators.

+
Oath of Office for Consul
2nd rule
+
English Version
""The following oath must be taken publicly in the major public fora of Nova Roma before someone elected or appointed to any magistracy can assume his or her office. It must be taken on the day, or as soon as possible afterwards, that the office is to be assumed. The office shall be considered vacant until the oath is taken. " Lex Cassia Iunia de iusiurando - 3rd §.
+
I, [enter Roman name here / enter macronational name here], as consul of Nova Roma,
+
do hereby solemnly swear that I will bear true faith and allegiance to the Senate and People
+
of Nova Roma, the New Roman Republic, Nova Roma, and to the majesty of the New Roman
+
people, the Quirites.

+
I, [enter only Roman name here], swear that as consul I will serve, protect and defend the
+
republic, the laws and the Declaration of Nova Roma, that I will always act in the best
+
interests of the Senate and People of Nova Roma, and that I will fulfill the obligations and
+
responsibilities of the office of consul to the best of my abilities.

His or her office
+
I further swear that as consul I will follow the mos maiorum, I will honor the Gods of Rome
+
in my public dealings, I will uphold and defend the Roman religion as the State Religion of
+
Nova Roma, and that I will promote the culture of ancient Rome and pursue the Roman
+
virtues in my public and private life.

Incidentally, lex Cassia reminds that our magistracies can be occupied by women or men.
+
In the presence of my ancestors and the Gods of the Roman people, by their will and favor,
+
I hereby accept the office of consul and all the rights, privileges, obligations, and
+
responsibilities attendant thereto.

+
Latin Male Version
Publicly in the major public fora of Nova Roma
+
Ego, [enter Roman name here / enter macronational name here], consul Novae Romae,
+
fidem atque pietatem Senatui Populoque Novo Romano, Rei Publicae Novae Romanae,
+
Novae Romae, maiestatique Populi Novi Romani Quiritium servaturum esse me sollemniter
+
iuro.

Modified lex Iunia is well in the spirit of Nova Roma: in order our magistrates be responsible, they are to take their oath publicly, towards the People. The requirement of posting the oath in the fora of Nova Roma is thus a logical ones.
+
Ego, [enter only Roman name here] consul rem publicam, leges, Declarationem Novae
+
Romae protecturum et defensurum, semper pro Senatu Populoque Novo Romano acturum,
+
officiis muneribusque consulatus quam optime functurum esse me iuro.

The expression "major public fora" asks however two questions.
+
Ego praeterea consul morem maiorum secuturum, deos Romanos in rebus publicis
First, and though the redundance "public+fora" may seem not necessary, the law does not say what are the major public fora of Nova Roma. This problem opens at this step two under-questions: first separating major fora from minor ones; second, defining a limited list of major fora, which thus form *the* major fora. Second, it does not specify what is a forum.
+
culturum, religioni Romanae fauturum eamque religionem publicam Novae Romae
+
defensurum, culturam Romanam antiquam propagaturum, virtutes Romanas in publica
+
privataque vita persecuturum esse me iuro.

Several other texts help us to answer that every internet discussion list, especially open on Yahoo! groups networks are such fora from the moment they are open to every one, at least to the citizens of Nova Roma, the magistrates being not responsible towards socii (i.e. non Novaromans).
+
Praesentibus Manibus omnibusque Deis populi Romani, ipsis volentibus propitiis,
+
consulatum una cum iuribus, privilegiis, officiis muneribusque propriis accipio.

The major internet discussion list in Nova Roma is what is called "the Forum" or "the Main List" (abbr. 'ML'), and hosted at: http://groups.yahoo.com/group/Nova-Roma .
+
Latin Female Version
But lex Iunia modified does not say what other list is placed into the group of "major public fora". Without further element, we are drawn to consider that every list, where every citizen can freely suscribe in, may be considered as a "major public" forum. Three lists can then claim for this qualification :
+
Ego, [enter Roman name here / enter macronational name here], consul Novae Romae,
- the Comitia centuriata list ;
+
fidem atque pietatem Senatui Populoque Novo Romano, Rei Publicae Novae Romanae,
- the Comitia tributa list ;
+
Novae Romae, maiestatique Populi Novi Romani Quiritium servaturam esse me sollemniter
- the Nova Roma announce list.
+
iuro.

Every oath should thus, legally, be issued in one of these four public fora.
+
Ego, [enter only Roman name here] consul rem publicam, leges, Declarationem Novae
+
Romae protecturam et defensuram, semper pro Senatu Populoque Novo Romano acturam,
+
officiis muneribusque consulatus quam optime functuram esse me iuro.

+
Ego praeterea consul morem maiorum secuturam, deos Romanos in rebus publicis
+
culturam, religioni Romanae fauturam eamque religionem publicam Novae Romae
+
defensuram, culturam Romanam antiquam propagaturam, virtutes Romanas in publica
+
privataque vita persecuturam esse me iuro.

Before (..) any [magistrate] can assume his or her office
+
Praesentibus Manibus omnibusque Deis populi Romani, ipsis volentibus propitiis,
+
consulatum una cum iuribus, privilegiis, officiis muneribusque propriis accipio.

Lex Iunia is clear: if each of the above requirements is not obeyed, the concerned magistrate cannot, in regard of our Law, assume her/his magistracy, and can be contested in her/his office during the rest of the year term.

The following oath
+
Oath of Office for Praetor
The required oath is the following one :
+
English Version
"I, (enter the legal and Roman names here) do hereby solemnly swear to uphold the honor of Nova Roma, and to act always in the best interests of the people and the Senate of Nova Roma.
+
I, [enter Roman name here / enter macronational name here], as praetor of Nova Roma,
+
do hereby solemnly swear that I will bear true faith and allegiance to the Senate and People
+
of Nova Roma, the New Roman Republic, Nova Roma, and to the majesty of the New Roman
+
people, the Quirites.

As a magistrate of Nova Roma, I, (enter the Roman name here) swear to honor the Gods and Goddesses of Rome in my public dealings, and to pursue the Roman Virtues in my public and private life.
+
I, [enter only Roman name here], swear that as praetor I will serve, protect and defend
+
the republic, the laws and the Declaration of Nova Roma, that I will always act in the best
+
interests of the Senate and People of Nova Roma, and that I will fulfill the obligations and
+
responsibilities of the office of praetor to the best of my abilities.

I, (enter legal the Roman name here) swear to uphold and defend the Religio Romana as the State Religion of Nova Roma and swear never to act in a way that would threaten its status as the State Religion.
+
I further swear that as praetor I will follow the mos maiorum, I will honor the Gods of Rome
+
in my public dealings, I will uphold and defend the Roman religion as the State Religion of
+
Nova Roma, and that I will promote the culture of ancient Rome and pursue the Roman
+
virtues in my public and private life.

I, (enter legal the Roman name here) swear to protect and defend the Constitution of Nova Roma.
+
In the presence of my ancestors and the Gods of the Roman people, by their will and favor,
+
I hereby accept the office of praetor and all the rights, privileges, obligations, and
+
responsibilities attendant thereto.

I, (enter legal the Roman name here) further swear to fulfill the obligations and responsibilities of the office of (enter the title of the office here) to the best of my abilities.
+
Latin Male Version
On my honor as a Citizen of Nova Roma, and in the presence of the Gods and Goddesses of the Roman people and by their will and favor, do I accept the position of (enter title of office here) and all the rights, privileges, obligations, and responsibilities attendant thereto."
+
Ego, [enter Roman name here / enter macronational name here)], praetor Novae Romae,
+
fidem atque pietatem Senatui Populoque Novo Romano, Rei Publicae Novae Romanae,
+
Novae Romae, maiestatique Populi Novi Romani Quiritium servaturum esse me sollemniter
+
iuro.

It is not necessary to comment the contents of this oath. Several precisions are however necessary on its form.
+
Ego, [enter only Roman name here] praetor rem publicam, leges, Declarationem Novae
+
Romae protecturum et defensurum, semper pro Senatu Populoque Novo Romano acturum,
+
officiis muneribusque praeturae quam optime functurum esse me iuro.
+
+
Ego praeterea praetor morem maiorum secuturum, deos Romanos in rebus publicis
+
culturum, religioni Romanae fauturum eamque religionem publicam Novae Romae
+
defensurum, culturam Romanam antiquam propagaturum, virtutes Romanas in publica
+
privataque vita persecuturum esse me iuro.

First, what the oath calls the "legal name" is obviously what was called the "macronational" name, i.e. the name under which the Novaroman citizen is registered in the current country of the world where (s-)he dwells in. For example, if Prima SECUNDA Tertia has a "macronational" passport with the name "Ashley TAGLIAPRADESH", this last one is her "legal name", in the frame of Lex Iunia de iurisiurando.
+
Praesentibus Manibus omnibusque Deis populi Romani, ipsis volentibus propitiis,
The requirement of the so-called "legal name" is necessary, in order to check if the citizen taking her/his oath is well identified, in our album civium's files, as the one whose Roman name is linked to the "legal name" displayed.
+
praeturam una cum iuribus, privilegiis, officiis muneribusque propriis accipio.

Second, lex Iunia has just displayed the oath in English. It means that every other version, even if created on good will reasons, have no legal value. As long as lex Iunia is not modified, it concerns every other non-English formula, even the Latin one, which is currently, in addition, not true in regard of the English version.
+
Latin Female Version
The magistrates are thus reminded not to forget taking their oath in the English version, every other one being indifferent. Such ones can naturally be used for communication intents, but may also, being wrong, create unwished consequences.
+

Third, the above oath is the only accepted one: every other one, even in English, which would change one letter, one or several words of this text, even in good will, would be regarded as void.
+
Ego, [enter Roman name here / enter macronational name here)], praetrix Novae Romae,
+
fidem atque pietatem Senatui Populoque Novo Romano, Rei Publicae Novae Romanae,
+
Novae Romae, maiestatique Populi Novi Romani Quiritium servaturam esse me sollemniter
+
iuro.

+
Ego, [enter only Roman name here] praetrix rem publicam, leges, Declarationem Novae
+
Romae protecturam et defensuram, semper pro Senatu Populoque Novo Romano acturam,
+
officiis muneribusque praeturae quam optime functuram esse me iuro.

The oath day
+
Ego praeterea praetrix morem maiorum secuturam, deos Romanos in rebus publicis
+
culturam, religioni Romanae fauturam eamque religionem publicam Novae Romae
+
defensuram, culturam Romanam antiquam propagaturam, virtutes Romanas in publica
+
privataque vita persecuturam esse me iuro.

It is on the day where the magistrate is required, according the law, to enter her/his office.
+
Praesentibus Manibus omnibusque Deis populi Romani, ipsis volentibus propitiis,
+
praeturam una cum iuribus, privilegiis, officiis muneribusque propriis accipio.

It means that this date is:

*Dec. 10th for the Tribunes of the Plebs;

*Jan. 1st for the other magistrates;

*On or from the day following the publication of the Senate session report on, after the Senate session which has appointed, for the concerned year term, the provincial governors;

*For the last magistrates who, for one or another reason, are elected or appointed during the civil year, from Jan. 1st to Dec. 31, the oath day is the day of or following the publication of the election or appointment.

Anyway, the oath must not be taken before the relative day, especially between the publication, for the central magistrates (except the Tribunes), of the annual elections and the following 31th of December.
+
Oath of Office for Aedilis Curulis
We can note that, even if the day is, according the religious calendar, "ater" or "nefastus", "publicus" or not, lex Iunia modified however authorizes that the concerned magistrates take their oath. No other public act must, still, be made by the new magistrates in such a day.
+
English Version
A relative oath day
+
I, [enter Roman name here / enter macronational name here)], as aedilis curulis of Nova
+
Roma, do hereby solemnly swear that I will bear true faith and allegiance to the Senate and
+
People of Nova Roma, the New Roman Republic, Nova Roma, and to the majesty of the New
+
Roman people, the Quirites.

We see that lex Iunia also allows the magistrate to take her/his oath "as soon as possible afterwards". But it does not specify when.
+
I, [enter only Roman name here], swear that as aedilis curulis I will serve, protect and
Such a silence is sound: it is the full interest of the magistrate to take her/his oath as soon as possible and with no delay. For as long as (s-)he does not, "the office shall be considered vacant".
+
defend the republic, the laws and the Declaration of Nova Roma, that I will always act in
+
the best interests of the Senate and People of Nova Roma, and that I will fulfill the
+
obligations and responsibilities of the office of aedilis curulis to the best of my abilities.
+
+
I further swear that as aedilis curulis I will follow the mos maiorum, I will honor the Gods
+
of Rome in my public dealings, I will uphold and defend the Roman religion as the State

Religion of Nova Roma, and that I will promote the culture of ancient Rome and pursue the
+
Roman virtues in my public and private life.

+
In the presence of my ancestors and the Gods of the Roman people, by their will and favor,
+
I hereby accept the office of aedilis curulis and all the rights, privileges, obligations, and
+
responsibilities attendant thereto.

A dangerous vacancy
+
Latin Male Version
Such a vacancy situation have two legal consequences: first the elected magistrate cannot act as magistrate, all her/his acts being void, and she/he could probably be sued if she/he willingly ignore this requirement ; second, it allows every high magistrate, authorized to convene the comitia, in charge of the election of the category of magistrates whose vacancy has been stated, in order to have it elect a new magistrate in the place of the defaulting one.

Preface

As is the case with most organizations, Nova Roma asks its citizens to respect a social contract. This contract consists of abiding by the constitution of Nova Roma, respecting the Religio Romana, and venerating the Roman values. Those who serve as Magistrates within Nova Roma take on additional duties however, and their combined work keeps the organization operational and in good stead. Due to the greater weight of responsibility they take on, those who enter into positions of Magistracy are asked to take an oath of office upon assuming the respective office.

Investiture Ceremony

Here follows the ceremony of investiture. You will see that you can simplify this ritual greatly if you want to avoid too much ceremony, and the ceremony also respects your personal religious views (you can do a Roman religious, a Christian or an irreligious version of it, whichever you prefer). You have to send the oath of office to TheForumRomanum@groups.io once the ritual of investiture is completed.

The ceremony of the investiture is below, if you cannot do parts of it, you can skip those parts, or figure out some kind of substitution ideas.

First Step

You should don your simple white toga and your tunica of your status (for example equestrian if you are one, or senatorial if are, or by taking this office, are becoming one). Women can don a white toga or a white palla if they prefer, or if there is no white, any color will do which you consider your best clothes. If you don't have Roman clothes, simply close up nicely as worthy of the occasion.

Second Step

While wearing your toga offer a sacrifice of wine or incense or a libum of bread, fruit, or milk and make a prayer in which you ask the Roman gods to acknowledge your entrance to the position to which you are about to enter, asking their support to ensuring you bring glory and happiness to Nova Roma and the Nova Roman people. If you adhere to the Cultus Deorum ensure that Jupiter Optimus Maximus is invoked and, if you do not cultivate the Roman gods, simply make a prayer to your god of choice instead.

Third Step

If you are a curule magistrate you should change from your plain white toga to a purple-bordered toga (the toga praetexta). After completing this next step, all citizens taking an oath should touch a symbol of Nova Roma (i.e. a Nova Roma banner, printed logo, or drawing of the emblem of Nova Roma).

Fourth Step

While vested in toga praetexta and holding the symbols of your office (if you have any), read aloud in Latin and/or in your NATIVE TONGUE the version the Oath of Office. The symbol of consulship, praetorship and curule aedileship can be the toga praetexta, sella curulis, an eagle, a scepter; for the consulship and praetorship only the fasces or a sword.

Fifth Step

After completing your oath, you will need to proclaim aloud that you have ascended to your new position in Latin. Using the proper Latin title for your given position, declare:

"[Latin Position Name] factus sum!" (I have been made a [Your New Position]).

Once you have done this you are ready to assume your new position!

Sixth Step

Make a post on Nova Roma's Main List (The Forum Romanum) stating your name and confirming that you have performed the ritual of investiture and offered sacrifice.
