Consular edict on the conduct of elections in the comitia centuriata and comitia populi tributa
AMENDMENT TO THE CONSULAR EDICT (MESSAGE 88880 MAIN LIST) ON THE CONDUCT OF ELECTIONS IN THE COMITIA CENTURIATA AND COMITIA POPULI TRIBUTA, ISSUED UNDER THE AUTHORITY OF THE SENATUS CONSULTUM ULTIMUM (SCU) CONCERNING THE CONDUCT OF ELECTIONS (PASSED NOVEMBER 2764 A.U.C AND EXPIRING DECEMBER 31ST 2765 A.U.C.) AS CORRECTED BY EDICT (MESSAGE 88881 MAIN LIST).
1. Section 1 of the corrected edict (messages 88880 and 88881 as above ) shall be amended to read:
- 1. Under the authority of section 4 of the above SCU, all legal requirements under Nova Roman law (as defined by Section I.B of the Nova Roman Constitution) concerning the timing and number of days for the call for candidates, the contio and the vote, or any other legal honors, powers, responsibilities or other rights or responsibilities that would otherwise conflict with the provisions of this edict and the conduct of the electoral process are abrogated and shall be deemed to be void and thus non-existent for the elections in the Comitia Centuriata and Comitia Populi Tributa during December 2765 A.U.C.
2. Section 6 of the corrected edict (messages 88880 and 88881 as above) shall be amended to read:
- 6. The process of validation of candidates for election shall be conducted by the presiding magistrate of the elections to the comitia centuriata and comitia populi tributa. Certification of each and all candidates shall occur prior to the commencement of voting. No candidate's name shall be legally entered onto a ballot unless certified by the presiding magistrate. An uncertified candidate's election to office shall be considered void of all legal standing. The requirements for candidacy are that individuals shall meet all the Nova Roman legal age requirements for the office that he/she is standing for election for, be currently certified as holding assidui status by the Chief Financial Office (CFO) of Nova Roma and be in good standing.
3. Section 8 of the corrected edict (messages 88880 and 88881 as above) shall be amended to read:
- 8. The presiding magistrate shall be the sole arbiter of all interpretations and applications of the provisions of this edictum and of any other matter affecting the conduct of these elections.
4. The corrected edict (messages 88880 and 88881 as above) shall be amended to include a section numbered 9 as follows:
- 9. In order to ensure that auspices are taken prior to the commencement of the contio for these elections any legal authority, and/or section thereof of such a legal authority, (such a legal authority being as defined by section I.B of the Nova Roma Constitution) that is concerned with the taking of the auspices shall also be abrogated and shall be deemed to be void and thus non-existent for the purposes of the elections in the Comitia Centuriata and Comitia Populi Tributa during December 2765 A.U.C. The presiding magistrate of the elections in the Comitia Centuriata and Comitia Populi Tributa during December 2765 A.U.C. shall take the auspices in respect of the entire electoral process. The result of the auspices, which shall be a statement solely as to whether they are favourable or unfavourable, shall be reported by the presiding magistrate to the Nova Roma Forum Romanum (aka “The Main List”) prior to the opening of the contio. This shall be the only permitted and required legal method of taking and reporting the auspices for this election.
5. The corrected edict (messages 88880 and 88881 as above) shall be amended to include a section numbered 10 as follows:
- 10. The presiding magistrate shall be the magistrate who issued the first Call for Candidates to the Nova Roma Forum Romanum (aka “The Main List”) for the December 2765 A.U.C. elections in the Comitia Centuriata and the Comitia Populi Tributa.
6. The corrected edict (messages 88880 and 88881 as above) shall be amended to include a section numbered 11 as follows:
- 11. The Call for Candidates issued in respect the December 2765 A.U.C. elections in the Comitia Centuriata and the Comitia Populi Tributa, this edict, the corrections on the edict subject of message 88881 as above, and any other subsequent amendments or corrections to the edict subject of message 88880 as above are consular edicts issued under the authority of the Senatus Consultum Ultimum concerning elections (passed November 2764 A.U.C.as above).
CONSULAR EDICT ON THE CONDUCT OF ELECTIONS IN THE COMITIA CENTURIATA AND COMITIA POPULI TRIBUTA, ISSUED UNDER THE AUTHORITY OF THE SENATUS CONSULTUM ULTIMUM (SCU) CONCERNING THE CONDUCT OF ELECTIONS (PASSED NOVEMBER 2764 A.U.C AND EXPIRING DECEMBER 31ST 2765 A.U.C.)
1. Under the authority of section 4 of the above SCU, all legal requirements under Nova Roman law (as defined by Section I.B of the Nova Roman Constitution) concerning the timing and number of days for the call for candidates, the contio and the vote, or any other legal requirement that would otherwise conflict with the provisions of this edictum, are abrogated for the elections in the Comitia Centuriata and Comitia Populi Tributa during December 2765 A.U.C.
2. The call for candidates for the comitia at section (1) above shall commence at midnight Mountain Time (GMT -7hrs) on the 7th December 2765 A.U.C. and conclude at 11.59pm Mountain Time on 9th December 2765 A.U.C.
3. There shall be one contio period for both comitia at section (1) above, which shall run from midnight Mountain Time on the 11th December 2765 A.U.C. to 11.59 pm Mountain Time on 13th December 2765 A.U.C. inclusive.
4. Voting for candidates standing for election in the Comitia Centuriata shall commence at midnight Mountain Time on the 18th December. The cista shall only be open for voting on candidates for election in the Comitia Centuriata on the 18th, 20th and 22nd of December 2765 A.U.C.
5. Voting for candidates standing for election in the Comitia Populi Tributa shall commence at midnight Mountain Time on the 27th December. The cista shall only be open for voting on candidates for election in the Comitia Centuriata on the 27th, 28th and 29th of December 2765 A.U.C. between the hours of midnight and 11.59pm Mountain Time on each of those days.
6. The process of validation of candidates for election shall be conducted by the Consuls. Certification of each and all candidates shall occur prior to the commencement of voting. No candidate's name shall be legally entered onto a ballot unless jointly certified by both the Consuls. An uncertified candidate's election to office shall be considered void of all legal standing. The requirements for candidacy are that individuals shall meet all the Nova Roman legal age requirements for the office that he/she is standing for election for, be currently certified as holding assidui status by the Chief Financial Officer of Nova Roma and be in good standing.
7. The custodes shall publish all election results in the Nova Roma Forum Romanum (aka the "Main List") before 11.59 pm Mountain Time on December 30th 2765 A.U.C.
8. The Consuls shall jointly be the sole arbiters of all interpretations and applications of the provisions of this edictum and of any other matter affecting the conduct of these elections.
